Building Regulation Application Types

The type of submission that can be made depends upon the circumstances.  There are three types of application.

Some very minor works are exempt - pdf document (new window) from the requirements but as a general rule most building work, and certain changes of use require approval under the Building Regulations.

Building work includes the removal of internal walls, the installation of fittings, the replacement of windows and doors containing glazing, constructing rooms in roof spaces and the construction of garages and extensions.

Compliance has to be shown in one of two ways, the deposit of a Full Plans Application - pdf document (new window) or by giving the Council a Building Notice - pdf document (new window).  Where building work has been carried out without permission being obtained from the Local Authority, Regularisation - pdf document (new window).
 

Full Plans Application

The depositing of a Full Plans Application - pdf document (new window) is the way the majority of applications are dealt with.  The person undertaking building work prepares, usually by employing an agent, detailed plans and these are checked for compliance by the Council.

The council has to arrive at a decision within a set period and has the option to Approve, Approve Conditionally or Reject the plans.

The Building Regulations accept that people have the right to build and therefore unless the plans are shown to be wrong in some way they will be approved.

Building Notice

The second method is a Building Notice - pdf document (new window).  This is used for less complicated developments and cannot be used for some classes of work.  The notice is simply a method of advising the Council that work is to be carried out.  There is no decision process but the builder has to show compliance on site.  "Building Notices" cannot be submitted for commercial premises.

Regularisation

Regularisation - pdf document (new window) is an application for retrospective approval.  However it cannot be applied for when the works were carried out before November 1985.  This application can only be made for works that have been completed without approval from building control.  Applicants for a "Regularisation" certificate should be aware that building control are likely to ask for works to be opened up for inspection.  The details of any work that is found not to comply with the Building Regulations will be sent to you in writing and it is then up to you to put the work right.  A "Regularisation" certificate will be given when all of the work have been rectified and comply with the regulations that were in force at the time the works were carried out.

In all cases there are fees to be paid.  These are set by the Local Authority, and are based upon a number of factors including the size, cost and complexity of the project.
