Article 4(2) Directions
Normally, minor alterations can be made to a dwelling without the need to apply for Planning Permission. This is called Permitted Development. Unfortunately, the cumulative effect of many small, but visible, changes to properties can result in the erosion of the character of an area, particularly in Conservation Areas. To counter this, a local authority can apply an "Article 4(2) Direction" to a Conservation Area to restrict such alterations within the defined area.
Article 4(2) Direction for Northgate
The Article 4(2) Direction for Northgate Conservation Area has been made under the Town and Country Planning (General Permitted Development) Order 1995, withdrawing permitted development rights to residents within the Northgate Conservation Area, where development (as highlighted below) would front a highway. This means that changes to the exterior of a property, previously not requiring Planning permission, from 24th November 2006 now requires an application for Planning Permission to be submitted to the Council for approval.
Fees for all planning applications arising from the implementation of the Article 4(2) Direction will not be required with such applications.

Affected Items
Planning applications are required to be submitted for all changes where they would front either a highway, a watercourse or a public open space, itemised as follows:
- The enlargement, improvement or other alteration of a dwellinghouse, where any part of the enlargement, improvement or alteration would front a highway;
- The alteration would be to a roof slope which fronts a highway;
- The erection or construction of a porch outside any external door of a dwellinghouse, where the external door in question fronts a highway;
- Provision within the curtilage of a dwellinghouse of any building or enclosure, swimming or other pool, where the building or enclosure, swimming or other pool to be provided would front a highway, or where the part of the building or enclosure maintained, improved or altered would front a highway;
- The provision of a hard surface for any purpose incidental to the enjoyment of a dwellinghouse, where the hard surface would front a highway;
- The installation, alteration or replacement of an antenna on a dwellinghouse or within the curtilage of a dwellinghouse, where the part of the building or other structure on which the antenna is to be installed, altered or replaced fronts a highway;
- The erection, alteration or removal of a chimney on a dwellinghouse or on a building within the curtilage of a dwellinghouse;
- The erection, construction, maintenance, improvement or alteration of a gate, fence wall or other means of enclosure, where the gate, fence, wall or other means of enclosure would be within the curtilage of a dwellinghouse and would front a highway;
- The painting of the exterior of any part, which fronts a highway, of a dwellinghouse; or any building or enclosure within the curtilage of a dwellinghouse;
- The gate, fence, wall or other means of enclosure is within the curtilage of a dwellinghouse and fronts a highway.
