Landowner statements
Landowners can formally protect their land from the creation of public rights of way or village greens by depositing the appropriate statements and maps with Darlington Borough Council.
Under current legislation, there are two types of deposits you can make:
- Statements and declarations under Section 31(6) of the Highways Act 1980 [internal link, opens in new window]
- Landowner statements under Sections 15A and 15B of the Commons Act 2006
Under sections 15A and 15B of the 2006 Act a landowner may deposit with the Authority a ‘landowner statement’ and map in respect of their land which brings to an end any period of recreational use ‘as of right’ over the land to which the statement and map relate.

The forms to be completed are contained in the schedule to The Commons (Registration of Town or Village Greens) and Dedicated Highways (Landowner Statements and Declarations) (England) Regulations 2013 [pdf document, external link]
Applications under Section 15A & B are to be submitted to: The Registrar of Common Land and Village Greens, Local Land Charges Section, Darlington Borough Council, Town Hall, Darlington DL1 5QT.
Applications and further queries under Section 31(6) of the Highways Act 1980 should be submitted to the Rights of Way Officer via [email protected]
All applications must be accompanied by an administration fee of £220 (per parcel), which is non-returnable.

Location of the registers
The Register of Common Land and Town or Village Greens and the Register of section 15A statements can be viewed in person at the Local Land Charges Service at the Town Hall, Darlington DL1 5QT.
The registers are available for public inspection on Mondays to Fridays (except public holidays) between 9:15am and 4pm by prior appointment. Appointments can be made on 01325 403145.
