Council Tax Energy Rebate and Discretionary Fund

Who do you keep information about?

We keep information about occupiers/owners of domestic properties in Darlington and members of their household.

Why do you keep information about me?

To administer £150 Council Tax Energy Rebate and provide support to other energy bill payers who are not eligible under the terms of the core scheme.

We are relying on the following UK GDPR conditions to process your personal data:

Article 6 1. (e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller

Article 9 2. (g) processing is necessary for reasons of substantial public interest and is authorised by domestic law

The legislation underpinning this processing is the Council Tax (Demand Notices and Reduction Schemes) (England) (Amendment) Regulations 2022.

Who can see my information?

System access is restricted to officers in Revenues and Benefits, Customer Services, Housing, and Financial Protection.

We may share your information with The Department for Levelling Up, Housing and Communities who will undertake a monthly DELTA collection exercise to monitor implementation progress.

The Council also uses Spotlight [external link], the Government’s automated due diligence tool to process grant applications.

How do you store the information you keep about me?

We store the information on our secure computer network and sometimes in paper format.

How long do you keep information about me?

The retention period for Council Tax records is 7 years from the last action. This information is destroyed securely when we no longer need it.

Is my information used to make an automated decision about me and/or for profiling purposes?

We will determine eligibility based on the information we hold in our Council Tax database.

You do have the right not to be subject to a decision based solely on automated processing.

You can ask for any automated decision made about you to be reviewed by an individual.

How did the Council get my personal data?

As well as the information you provide, we may also get information from, GPs, Benefits Section, Landlords and Letting Agents, Tell Us Once, and Electoral Registration.

In cases where your personal data was obtained from a source other than yourself or your representative, we will inform you of the origin of the information within 1 month, unless that information is being used to contact you, in which case, that information should be provided to you at the latest, upon first communication with you.

However, we are not required to provide that information in cases where you already possess the information, where recording or disclosure is expressly laid down in law or where provision of the information proves impossible or would involve disproportionate effort.
